Overturn of Whiplash Award
In the January, 1997, issue of the Soft-Tissue Review, we reported that Nicholas Dingley, in Scotland, was awarded US$880,000 after a judge accepted that the onset of his MS symptoms were triggered by a whiplash injury. Despite Mr. Dingley's medical evidence and expert witnesses, the case was recently overturned in Edinburgh. The head of the appeal court did not see a correlation between whiplash and the onset of MS; furthermore, the judge felt the evidence suggested that Mr. Dingley had MS before the injury, but that the symptoms were not "apparent" until after the accident. His reward was reduced to US$2,400, and his family is considering taking the case to the House of Lords for a final ruling.
